Mullican|Hart Litigators post another victory under the Federal Employer's Liability Act

George Mullican and team obtained a Summary Judgment in Tulsa County, Oklahoma, in an action brought under the Federal Employers’ Liability Act (FELA). The Plaintiff alleged that he had injured his shoulder necessitating surgery. The Plaintiff worked for the railroad for decades as a yard crewman and alleged that his injuries were due to cumulative traumas received over the course of his career. The Court concluded that Plaintiff had failed to establish negligence on the part of the railroad or medical causation as to any injury claimed. The ruling fully disposed of the case without the need for trial.
